Many homeowners today find themselves in a position where the value of their home has dropped to the point that it's now worth less than what they owe on the balance of the loan.  These homeowners who are upside down and want to get out from under their mortgage may have the option of selling their home as a short sale.
A Short Sale is far better on your credit rating than just letting the lender foreclose on your home.

A Short Sale transaction occurs, when a borrower cannot afford to pay off their mortgage on a property and the lender agrees to accept a payoff of less than the balance owed on the mortgage loan, agreeing to sell the property at a loss.  In contrast, a foreclosure is the legal termination of all rights of the borrower as the owner of the home, and the lender takes possession of the home which then becomes the property of the lending institution.

The Short Sale situation makes sense and has advantages for both parties as it allows the seller to avoid foreclosure and helps the lender eliminate the costs associated with the foreclosure.  Most lenders will comply with a short sale to avoid the time, trouble and costs of a foreclosure and at the same time the seller may also avoid earning a negative credit report.  Of course, there are no guarantees a short sale offer will be accepted by a lender.

A Short Sale costs the homeowner practically nothing as all of the expenses are paid for by the lender.  The lender pays all of the costs including title insurance, any county taxes or fees on the sale, attorney’s fees, as well as any real estate commission.
